Terms of Use

These terms are an agreement between you and Continuum Company for your use of Dawdle. By downloading or using Dawdle, you agree to them. If you do not agree, do not use the app. Please read the health and safety section carefully before practicing.

1 · What Dawdle is

Dawdle is a breathwork app offering guided breathing sessions, practice reminders, a breath-hold test, and progress tracking. Dawdle is a general-wellness product intended to support relaxation, focus, and breathing practice. It is developed by Continuum Company ("Continuum", "we", "us"), a company based in Saudi Arabia.

2 · Health and safety

Dawdle is not a medical device and provides no medical advice, diagnosis, or treatment. The breath-hold score is a general wellness metric reflecting your comfort with breath holds over time. It is not a medical test and does not measure lung capacity, lung function, or any medical condition.

Breathing exercises and breath holds involve physical activity and are not suitable for everyone. By using Dawdle you agree that:

3 · Who may use Dawdle

You may use Dawdle only if you can legally agree to these terms where you live. If you are under the age of majority, you may use Dawdle only with the permission and supervision of a parent or legal guardian who accepts these terms on your behalf.

4 · Dawdle Pro subscriptions

Some features require a Dawdle Pro subscription, offered as an auto-renewing monthly or annual plan, with pricing shown in the app and in the App Store at the time of purchase. Where offered, eligible users may receive the free trial shown before purchase; Apple determines eligibility.

5 · License and Apple's Standard EULA

Apple's Standard Licensed Application End User License Agreement also governs your license to use Dawdle. These terms supplement, and do not replace, Apple's Standard EULA. If these terms conflict with Apple's Standard EULA, Apple's Standard EULA controls to the extent of the conflict.

Subject to Apple's Standard EULA, we grant you a personal, non-exclusive, non-transferable, revocable license to use Dawdle on Apple devices you own or control. You may not copy, modify, distribute, sell, sublicense, reverse-engineer, or create derivative works from Dawdle except as permitted by law. Dawdle's name, original descriptions, selection and arrangement of content, text, design, artwork, sounds, and code are owned by us or our licensors and protected by intellectual-property laws.

6 · Your data

Dawdle stores your practice data locally on your device and does not transmit it to the developer. If you choose Contact support and affirmatively send the visible email, the developer may receive your support correspondence and any redacted diagnostic attachment you leave in the message. See the Privacy Policy, which forms part of these terms. You are responsible for your device and its backups; we cannot recover data stored only on your device.

7 · Acceptable use

You agree not to misuse Dawdle, interfere with its operation, circumvent its security or access controls, use automated means to extract its content, violate another person's rights, or use it in violation of applicable law, Apple's terms, or the safety commitments above.

8 · Disclaimer of warranties

Dawdle is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that it will produce any particular wellness outcome. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.

9 · Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising from your use of (or inability to use) Dawdle. To the maximum extent permitted by law, our total aggregate liability for all claims relating to Dawdle is limited to the amount you paid us for Dawdle in the twelve months before the claim arose. Nothing in these terms excludes liability that cannot be excluded by law.

10 · Termination

You can stop using Dawdle at any time by deleting the app, but deleting the app does not cancel an App Store subscription. We may terminate or suspend the license if you materially breach these terms. Sections 2, 5, 6, 8, 9, and 12–14 survive termination.

11 · Changes to Dawdle or these terms

We may update Dawdle, add or remove features, and update these terms from time to time. If we make material changes, we will update the effective date and version above and present the change clearly. Continuing to use Dawdle after a change takes effect means you accept the updated terms.

12 · Governing law and courts

These terms are governed by the laws of the Kingdom of Saudi Arabia, excluding its conflict-of-law rules. To the fullest extent permitted by law, the competent courts of the Kingdom of Saudi Arabia have exclusive jurisdiction over disputes relating to Dawdle or these terms. Nothing in this section deprives you of mandatory consumer protections or a mandatory right to bring a claim in another court.

13 · Apple-specific terms

These terms are between you and Continuum, not Apple. Apple has no obligation to provide maintenance or support for Dawdle and is not responsible for addressing claims relating to it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. Your use of Apple Health, StoreKit, the App Store, device backups, and other Apple services is also governed by Apple's terms and may be changed or become unavailable independently of Dawdle.

14 · General

If any part of these terms is found unenforceable, the rest remains in effect. A failure to enforce a provision is not a waiver. These terms, the Privacy Policy, and Apple's Standard EULA are the entire agreement governing your use of Dawdle.
